Someone has committed a crime against me. Can I file a report with your office?
No. All crime reports must be initiated through the Coeur d'Alene Police Department before our office can take action.
No. Decisions regarding whether to file charges, how to prosecute a case, and whether to dismiss (or “drop”) charges are all within the prosecutor's discretion. While you may share your concerns and reasons for requesting dismissal, the prosecutor is not obligated to follow your wishes. Prosecutors are ethically required to pursue what they determine to be in the best interest of justice based on the totality of the circumstances.

Under Idaho law, a victim is entitled to reimbursement from a defendant for expenses directly resulting from a criminal offense. This reimbursement is known as restitution. A victim may request that the criminal court order the defendant to pay restitution for expenses that are not covered by insurance, such as deductibles, property damage, or loss of wages.
The purpose of restitution is to provide a quicker and less expensive method for victims to obtain financial reimbursement than going through the civil system. There is no guarantee that restitution will be ordered in any specific case; however, it is ordered in the great majority of cases. The availability of restitution, eligible expenses, and the process for obtaining restitution are governed by Idaho Code § 19-5304.
Do you prosecute all the cases that occur within the city limits of Coeur d'Alene?
No. Our office has jurisdiction over all state misdemeanor and infraction offenses that occur within the city limits of Coeur d’Alene, as well as violations of the Coeur d’Alene municipal code.
The Kootenai County Prosecutor's Office handles:
- All felony cases (unless conflicted out)
- Juvenile cases (unless conflicted out), with the following exceptions:
- Misdemeanor driving offenses (DUIs, Reckless/Careless Driving, etc.)
- Infractions
- Possession of Tobacco or Alcohol
- Cases initiated by Kootenai County Sheriff Deputies and Marine Division
- Cases initiated by Idaho State Police Troopers
