Requesting Discovery (Pro Se Defendants)

If you are not represented by an attorney and intend to represent yourself in court (meaning you are proceeding pro se), you may submit a written request for discovery to our office.  The request may be submitted in one of the following ways:

  • In person: Our office is located at the above mailing address on the second floor of City Hall 

Your written request must include the following: 

  • Your full legal name
  • The specific criminal case number and citation number (if applicable)
  • The specific items you are requesting to be provided in the discovery
  • The mailing address to which the discovery should be sent

If you would prefer to receive discovery electronically, please include a valid email address.  If you would prefer to pick up discovery from our office, please include a reliable phone number or email address so that we can notify you when the discovery is ready.

Pursuant to Idaho Criminal Rule 16(f), our office will respond to discovery requests within fourteen (14) days of receipt. IMPORTANT NOTE: Our office will provide discovery materials for a criminal case only one time. If you later decide to retain counsel, whether by hiring private counsel or having the State Public Defender's Office appointed to represent you, it will be your responsibility to provide those discovery materials to your attorney.

 

Intoxilyzer Information

Our office will provide Intoxilyzer Logs only for the month in which the relevant breath test occurred in our discovery responses. For logs or Intoxilyzer packets outside of that time frame, please schedule an appointment with our office to view those additional documents.

Discovery Disclosure Policy

Our office provides discovery electronically through our case management system by providing an automated email with links to download each item being disclosed.  The links are valid for fourteen (14) days, after which they expire and the associated discovery items are automatically deleted from the secure cloud storage system.

We strictly enforce the fourteen (14) day window and will not resend discovery electronically if the recipient fails to access and download the disclosed items within that time frame.  If that occurs, the recipient may obtain the requested discovery items by providing our office with one or more new, unopened jump drive(s) with sufficient storage capacity to accommodate the full discovery contents being disclosed.  We will strive to get the contents downloaded to the provided media and make them available for pickup within two (2) business days of receipt.

For pro se defendants or attorneys without the ability to receive and download electronic discovery, please provide our office with one or more new-in-package jump drive(s) or one or more blank recordable disk(s) (either CD-R or DVD-R) with sufficient storage capacity to accommodate the full discovery contents being disclosed.  Once the media has been copied, our office will notify you that the materials are ready for pickup.

 

ITD Subpoena Duces Tecum for ALS Hearings

When requesting audio and/or video be sent to the Idaho Transportation Department (ITD) for Administrative License Suspension (ALS) hearings, please email the ITD subpoena duces tecum (SDT) to our office so that we may respond and forward the requested materials directly to ITD. If you are unable to email the SDT or have questions regarding this process, please contact our office for assistance.
